These terms and conditions apply to all purchases made through this website. By placing an order, you agree to the terms set out below.
1. Orders & Availability
All artworks are original, one-off pieces. Once sold, they will not be restocked.
In the unlikely event that an artwork becomes unavailable after purchase, we reserve the right to cancel the order and issue a full refund.
2. Pricing & Payment
All prices are listed in GBP (£).
Payment must be made in full at the time of purchase. Orders will not be dispatched until payment has been received.
We reserve the right to correct any pricing errors. If an error is identified after purchase, you will be offered the option to proceed at the correct price or receive a full refund.
3. Shipping & Delivery
We aim to dispatch orders within the timeframes stated on the website. Delivery timeframes are estimates and not guaranteed.
All artworks are carefully packaged and shipped using insured delivery services.
If any issues arise during transit, please contact us and we will work with the courier to resolve the matter as quickly as possible.
It is the customer’s responsibility to provide an accurate delivery address. We cannot be held responsible for delays resulting from incorrect or incomplete address details.
4. Delivery Issues & Re-shipping
If a delivery is missed and the artwork is returned to us, or if re-delivery is required for any reason outside our control, additional shipping costs may be charged before the artwork is resent.
5. Inspection on Arrival
Please inspect your artwork as soon as it arrives.
If your artwork arrives damaged, you must notify us within 48 hours of delivery. Please include photographs of:
- The artwork
- The packaging
- Any visible damage
All original packaging should be retained, as this may be required for insurance purposes.
Failure to report damage within this timeframe may affect our ability to resolve the issue.
6. Returns
If you wish to return an artwork, please contact us within 14 days of delivery.
Returned items must be sent back within 14 days of notifying us and must be in their original condition.
Customers are responsible for return shipping costs. We recommend using a tracked and insured service.
Once the artwork has been safely returned, a refund will be issued to the original payment method. Original shipping costs are non-refundable unless the item is faulty or damaged.
7. Damaged or Lost Items
If your artwork is lost or damaged in transit, please contact us as soon as possible.
All shipments are insured, and we will work with you and the courier to resolve the issue.
8. International Orders
International shipping is included where stated.
Orders shipped outside the UK may be subject to import duties and taxes. These charges are the responsibility of the customer.
We are not responsible for delays caused by customs.
If an order is refused and returned to us, any additional costs incurred may be deducted from your refund.
9. Artwork & Product Representation
Each piece is hand-painted and unique.
While we make every effort to display colours accurately, they may vary slightly depending on your screen or device.
10. Intellectual Property
All artwork remains the intellectual property of Helen C. Stark.
The purchase of an artwork does not grant the right to reproduce, distribute, or commercially use the image without prior permission.
11. Limitation of Liability
We are not liable for any indirect or consequential losses arising from the purchase of our artwork.
Our liability is limited to the purchase price of the artwork.
